Is anyone out there a lawyer?

ourladypeace.net currently has a contest going for fanclub members to win front row tickets to concerts on the upcoming Canadian tour.

The contest is only open to people who pay the $25 or $35 ourladypeace.net membership fee, and the winner is selected at random. It is my understanding that that makes it an illegal lottery in the United States (where the company that owns ourladypeace.net and is running the contest is located). Do we have any lawyers on here, or people who are friends with a lawyer, that could confirm that what they're doing is in fact illegal? If so, send me a private message.

It's ironic, ourladypeace.net has only ever alienated fans from the band, which is counterproductive to what fanclubs are supposed to be about.

I don't think I understand. Why is that illegal? I'm sure I'm missing something, but it seems to me that they're just offering a contest exclusive to fanclub members...

Have you ever seen a contest that didn't say "no purchase necessary to win" somewhere in the terms? They say that because it's required by law. There always has to be a free way to enter the contest. Unless it's based on skill rather than chance, because that's not a lottery.

In many cases, they are illegal too, I believe. There are state laws that regulate it.

I know that here if you do have a raffle and pay for tickets whoever's promoting it has to register it somewhere and conform to various details like printing the promoter's name and address and some registry number on all the tickets.

I asked my Dad (lawyer) about holding a contest when you have to purchase something, and if there is no purchase necessary then it's legal, but if you have to make a purchase then technically it's considered gambling and you need a gambling license. However, that's just Canada. It's different in the US but I'm not sure how.

It's the same in the US, and the purchase of a fanclub membership is required. I'm waiting to hear back from Lindsay as well, and then maybe I'll give UltraStar a phone call and ask them what they're going to do about it.

Also I believe you have to conform to the laws everywhere your contest is open to (which is why many US contests are open to US residents only).
